It is my understanding that Tmobile is responsible for the terms of service, so no tether apps but Google pulled the apps, I am sure that Tmobile had something to do with it. There should be a pettition to send to Google also so they could put presure on Tmo.

This is stupid. Why should Google & T-Mobile facilitate TOS violations, and potential losses of revenue? Personally, I don't really want everybody and their monkey tethering and hogging bandwidth, or doing anything that the widespread use/abuse of is going to cause problems and hurt the carrier & Android. If a limited number of people find their way around things, fine. If *everybody* does it, we're all gonna be screwed. If people aren't smart enough to get around the Market, that's their problem.

So glad to see the discussion here. I'm mainly glad that it's not just full of "Open Source is why I bought the phone! All apps should be free! Leave our Market alone! If TMobile closes the market, Android isn't open!" BS. It seems the vvvvvaaaasssssssttttt majority of Android users like the buzzword "Open Source" but have no idea what it means. The apps in the market really have practically 0 to do with open source. The apps we download aren't open source. The OS is.
And someone letting any and everything on the market doesn't make the market "open source". It just makes it unregulated. No one ever said Android would be unregulated. As long as you buy a branded device and/or use it on someone's network, you're going to have to agree to someone's rules to use it, period.
Even if Kogan used his OWN PHONE, and had his own public, fully open distro of Android on his own phone, and didn't get on a wireless provider's network, and only used his phone over Wi-Fi, he would STILL have to abide by his home Internet provider's TOS.
My greatest hope is that some day soon, the "Open Source" buzz about this OS will die down and people will just judge it on its merits.
