Yeah even if you have to send it back while you wait for the new one...do it! I believe I was past the 14 days, but I didn't care! I called, let them know my prob, which was really their prob, and they told me it would be no prob!lol..seriously its unexceptable and you should let them know that!
I just sent the preorder back yesterday. I called and gave tmo the tracking #s, then they credited my account for the phone & shipping cost!
Well I called on Nov 6 and asked for a replacement phone under the 30 days buyers remorse policy(California), they shipped it out on Nov 7, UPS shows that I will be getting it on Nov 11.. Hopefully I will get one of the new batch...
Well, it seems I am the only one who has no problems with first G1 I received. Battery life improved after I got first update to RC29 (RC28 was skipped for me for some reason) and now lasts instead of 2.5-3 days - 4 - 4.5 days.
I am no moderate user though but I do use phone and do talk a lot...
No creaks (DIY fix) and everything else is just as you are explaining on your second phone. Keyboard is good, everything works fast, very stable, no problems whatsoever... I am still testing it and as you said I still have 1 year warranty to go by due to my 14 days past about 4 days ago...

under what conditions does t-mo not take back a phone? let's say you accidentally dropped the phone from out of your lap when getting out of a car and there's a couple indentations in the corner of the phone...
I called in to customer care about last Wednesday, I ordered during the pre-order and they are sending me a refurbished! Does that sound about right? Because my trackball isn't as sensitive as when I got it..and I know there is a 30 day return policy in California but I pre-ordered so I don't know if that counts or what? The refurb is already on its way..so I dunno...any thoguhts?
When I did my replacement over the phone through customer care, they had me go to the local store (G1s are not sold in my non-3G market) to have the employees verify no physical or water damage. The employees called in, verified no damage, then they did my replacement no questions asked.
Since I was beyond the 14 days, they did a post-exchange. This means that I got to keep using my current G1. They sent me a brown box with JUST the phone in it...I had to keep my own battery, back cover, and MicroSD card.
My replacement did NOT come with a headset adapter or a software update...I am still on RC19.
The customer care rep id waive my replacement shipping charge, however...I had my replacement to my door the next day after I called, for free. I love the big pink T.

The "refurbished" thing is part of their script...they told me the same thing, and I got a brand new device...just didn't have any of the accessories with it. It literally looks like they took a new one out of the box and took the battery and back cover off of it and sent it to me. The original screen protector (not a replacement) was still there, and I still have RC19, which means it prolly has not connected to the network before I got it.

If you live in California and you have 30-day return policy here is how it should be: once you received the phone you count your 30 days from that date. You most likely received it on October 20th let's say and you have until November 20th, 2008 to return the whole thing.
Now here is the fishy part - You should NOT accept refurbished unit. You have right to get brand new phone under 30-day policy. That would mean you are paying 179.99 for refurb and that's just not right. I do not like refurbs but if that's replacement warranty agreement - oh well... but, you being under 30-day return policy you should get brand new phone.
My advice is: cancel that replacement and tell them why. Go return your phone (to store if you got it there, or call 611 and return it to them) and then order brand new one because I think that T-Mobile is trying to play you out on this one.
So far T-Mobile was ok to me but that's just because I like to yell and scream... jk - but you have to be demanding to get your things done...

All phones that are sent without battery cover and just as bare bone units are refurbished no matter how new they look like. It is not like getting refurb phone from third party store where scuffs may appear, etc. T-Mobile sent me about 3-4 units as replacements (refurbs) and they looked brand new - not a single scuff or scratch or anything ... however, I confirmed all times these were refurbs.
So, once under 30-day warranty you are entitled to get brand new phone with all accessories and return the previous package with everything in the box you have received the first time.

Ok I have a question about this replacement stuff. I have a bronze G1 that I bought off someone, only thing is, I got the phone, the box and SDcard only, had to get my own charger. Will tmo still exchange it if I have any manufactured issues?
